Article 2 These Provisions apply to the manufacture, sale, alteration, maintenance, routine maintenance, inspection, use and supervision and inspection of forklifts within the administrative jurisdiction of this Municipality.

 

The use of forklifts as used in these Regulations refers to the use of forklifts used in specific areas such as factories, docks, warehouses (hereinafter referred to as specific areas), supervision and management of forklifts used in construction sites and municipal engineering sites, and the competent administrative department in accordance with relevant laws. Regulations are enforced.

 

Article 3 The administrative department of quality and technology supervision of Guangzhou Municipality shall be responsible for the safety supervision of forklifts within the administrative area of ​​the city. The administrative departments of quality supervision of districts and counties shall be responsible for the safety supervision of forklifts within their jurisdiction.

 

Chapter II Manufacturing, Renovation, Repair and Sales of Forklifts

 

Article 4 The administrative license system shall be implemented for the manufacture of forklifts. A forklift shall not be manufactured without a manufacturing license. The forklift manufacturing unit shall carry out manufacturing activities in accordance with national safety technical specifications.

 

Article 5 In accordance with the requirements of the national safety technical specifications, new products and new components of forklifts, components or prototype forklifts that should be subjected to type testing must be type tested.

 

Article 6 Units engaged in the transformation and maintenance of forklifts shall have professional and technical personnel and technical workers appropriate to the maintenance of special equipment and necessary testing means, and consciously accept the supervision and inspection carried out by the special equipment safety supervision department according to law.

 

Article 7 When selling forklifts, the seller shall attach documents such as type test report, product quality certificate and use maintenance instructions that meet the requirements of national safety technical specifications.

 

Article 8 Foreign-funded enterprises selling forklifts manufactured overseas shall comply with the requirements of national safety technical standards and mandatory standards, and clarify the agents registered in China. The agent shall hold the relevant information to the special equipment safety supervision organization of the Guangdong Provincial Bureau of Quality and Technical Supervision for the record, and conduct the type test on the forklift to be sold in China. The imported type forklift qualified for the type test can be sold in China, and the agent is safe for the product. Quality is fully responsible.

 

Article 9 No unit or individual may sell illegally manufactured, illegally modified or illegally assembled forklifts.

 

Chapter III Use of Forklift

 

Article 10 The use unit of forklift refers to units and individuals that have the right to manage and manage forklifts (limited to individual business operators who have obtained industrial and commercial business licenses, hereinafter referred to as 'units'), including forklift registration units, contract safety management professional companies, and rental Units, renting units, end user units, etc.

 

Article 11 The forklift registration unit shall, within 30 days after the forklift is put into use or put into use, go to the quality and technology supervision and administration department of the district or county level city to register with the following materials, issue the registration certificate and obtain the forklift license:

 

(1) "Special Equipment Registration Form" (2 copies);

 

(2) A copy of the organization code certificate or business license of the registered unit;

 

(3) Factory certificate of conformity and use of maintenance instructions;

 

(4) The inspection report for the validity period;

 

(5) an operator certificate and a safety management personnel certificate (or an effective safety management contract);

 

(6) Safety management system or safety commitment.

 

Article 12 Where the registration contents of the forklift are changed or the ownership is transferred, the forklift registration unit shall, within 30 days, go through the corresponding procedures for change and transfer to the quality and technical supervision and administration department that has applied for registration.

 

Article 13 If there is a serious accident in the forklift truck, and there is no maintenance value or exceeds the service life specified in the safety technical specifications, the registration unit shall promptly scrap the waste and go through the formalities for cancellation with the original registration department.

 

Article 14 If the forklift uses the registration certificate, the license is lost or damaged, and the forklift registration unit applies for reissue, it shall submit the identity certificate, the lost declaration and the application materials to the original registration department. After the original registration department has verified the registration file, it will reissue it within 20 working days from the date of receipt of the application.
